SSA-Proposed Rule Changes to the Scheduling and Appearance at Hearings


Some SOAR programs represent applicants at the hearing level. SSA has proposed a rule change related to scheduling hearings. In summary, SSA proposes that when scheduling a hearing, SSA will notify the claimant that his or her hearing may be held by video teleconferencing. The claimant will have an opportunity to object to appearing by video teleconferencing within 30 days after the date he or she receives the notice, and no later than 5 days before the hearing. Also, if the claimant’s residence changes while his or her request for a hearing is pending, SSA may schedule a video hearing, even if the claimant objects.
